NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule was promulgated under authority of Section 4-2-10. Analytical service fees shall be charged as determined by the Department pursuant to Subsection 4-2-2(2). These sections are a result of Section 4-2-1 (Department created) and Section 4-2-5 (Organization of divisions within department).

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Department has received no comments supporting or opposing this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule allows charging of fees to other agencies, companies, and individuals for testing of samples on an as-needed basis. The law continues to require this rule; therefore, this rule should be continued.
