    Section 35A-4-207 provides that the Department should adopt rules for the allowance of benefits to a claimant who is partially employed.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    The Department has received no comments during the last five years.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The rule is necessary to establish definitions for self employment, corporate officers, commission salespersons etc. The rule also establishes guidance for determining unemployed status. Therefore, this rule should be continued.
