    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    This rule implements Section 63G-4-503 which authorizes the Division of Forestry, Fire and State Lands to provide the procedures for submission, review, and disposition of petitions for agency declaratory orders on the applicability of statutes, rules, and orders governing or issued by the agency.

    No comments have been received to date.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule gives persons an avenue to petition the Division for a declaratory order that established rights, status or other legal relationship under statute, rule or order. Without this rule, only applicants can petition the Division on property rights issues. Therefore, this rule should be continued.
