The rule is enacted pursuant to Section 72-1-201. Section 72-1-201 authorizes the Utah Department of Transportation the general responsibility for planning, research, design, construction, maintenance, security, and safety of state transportation systems. The implementation of this rule implements the "Adopt a Highway" volunteers program which goes to the portion of the code to maintain the transportation system.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
As written, this rule effectively establishes the procedure for using volunteer groups for litter pickups. It provides additional resources to increase the Department of Transportation's litter control efforts at a minimal cost. Therefore, this rule should be continued.
