Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Mandated by Section 36-11-404, "(1) The lieutenant governor shall make rules that provide: (a) for the appointment of an administrative law judge to adjudicate alleged violations of this section and to impose penalties under this section; (b) procedures for license applications, disapprovals, suspensions, revocations, and reinstatements that comply with the procedures and requirements of Title 63G, Chapter 4, Administrative Procedures Act."

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The lieutenant governor's obligation under Section 36-11-404 continues. Therefore, this rule should be continued. Due to a renumbering of the Administrative Procedures Act, the lieutenant governor will submit a nonsubstantive change request to correct statutory references within this rule.
