    The rule outlines minimum spending of Title IIIB funding on the categories of Access Services, In-Home Services, and Legal Assistance, as indicated in Section 62A-3-104, which authorizes and requires the division to comply with the Older Americans Act. This definition is included in the Older Americans Act and therefore is a requirement of Section 62A-3-104.

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    There has been no opposition to the rule and the division feels it should continue. The rule codifies the requirements of the Older Americans Act in providing minimum levels of the services indicated.
