    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Under Sections 23-14-18 and 23-14-19, the Wildlife Board is authorized and required to provide rules to regulate and prescribe the means by which protected wildlife may be taken.

     

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments were received since the last five-year review. The most recent amendment to the rule was made in August 2005 when it was amended to define limited entry hunt and limited entry permit, make harvest objective cougar permits statewide permits, and remove the female cougar subquota provision. Any general comments received are addressed using existing policies and procedures or the issue is placed on the Regional Advisory Council and Wildlife Board agendas for review and discussion during the process for taking public input. The public is welcome to view the Regional Advisory Counsel and Wildlife Board minutes for this rule by contacting any Division of Wildlife Resources office.

     

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Rule R657-10 provides the procedures and standards for taking and pursuing cougar. The provisions adopted in this rule are effective in administering the state's cougar management program and the continuation of this rule is necessary for its future success.
