    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-1-401(3) allows the Utah State Board of Education (Board) to adopt rules in accordance with its responsibilities and Section 53A-1-402 directs the Board to establish rules and standards for the public schools, including curriculum and instruction requirements.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    Utah Education Association submitted the following concerns on 06/17/2015: 1) the design, implementation and requirements control is taken away from LEAs and turned over to the superintendent and the Board; 2) it is not clear who or when a group would be required to submit an RFP; 3) provides that only superintendent can provide an application--is there anyone else?; 4) rule is not clear on how many community representatives there can be; and 5) is "education service plan" defined anywhere?

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because it provides standards and procedures for the distribution of money appropriated by the state to arts or science organizations. Therefore, this rule should be continued.
