Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 62A-11-104.1(2) requires the Office of Recovery Services (ORS) to specify by rule the type of health insurance and financial record information financial institutions and insurance companies are required to provide. Subsection 62A-1-111(16) gives the department authority and responsibility to collect child support payments and any other money due to the department. Section 62A-11-107 gives ORS the authority to adopt, amend, and enforce rules necessary to carry out its responsibilities under state law.

There have been no comments received since the last five-year review of the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule must continue for ORS to be in compliance with Subsection 62A-11-104.1(2). Information from financial institutions and insurance companies helps ORS successfully collect child support and provide insurance information to families.
