    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 31A-40-303(2) gives the commissioner authority to designate by rule one or more assurance organizations for certifying the qualifications of a professional employer organization. The purpose of the rule is to establish a process by which an assurance organization can be designated for certifying the qualifications of a professional provider organization.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    The department has not received any written comments regarding this rule in the past five years.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    As long as the law allows PEOs to be qualified by an assurance organization, this rule will be necessary to provide the steps to become an assurance organization. Therefore, this rule should be continued.
