    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule implements the parent participation fee for the Baby Watch Early Intervention Program. This fee was mandated by the Utah State Legislature in 2003. Section 26-10-2 instructs the Department of Health to provide services for children with a disability. Section 26-1-5 grants the Department of Health rulemaking authority to implement all of Title 26. Section 63G-3-201 states that rulemaking is required when an agency provides a material benefit, or when an agency issues a written interpretation of a state mandate.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    There have been no public comments received on this rule in the past five years.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The Baby Watch Early Intervention Program continues to operate, and to implement the parent participation fee required by the Utah State Legislature. In the 2013 General Legislative Session, the Utah Legislature increased the parent fee requirement under S.B. 2. The Department will be submitting a rule amendment to implement the new requirement.
