Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53A-1-401 allows the Utah State Board of Education (Board) to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law; and Section 53A-12-207 requires the Board to make rules providing for the disposal or reuse of useable textbooks in the public schools.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule continues to be necessary because it provides procedures for local education agency policies for the reuse or disposal of textbooks in the public schools. Therefore, this rule should be continued.
