    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-1-401(3) allows the Utah State Board of Education to adopt rules in accordance with its responsibilities, and Subsection 53A-1-402(1)(b) requires the Utah State Board of Education to establish rules concerning discipline and control of students.

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because it provides standards and procedures for school districts, schools, and charter schools when developing and implementing school discipline policies for students required by state law. Therefore, this rule should be continued.
