This rule is enacted in compliance with Sections 9-8-503 and 9-8-504 which state that a preservation easement may entitle its owner to take certain action, to require certain action to be taken by the owner of the burdened land, or require that certain action not be taken by the owner of the burdened land.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule establishes procedures for the adequate handling of preservation easements and their proper recording. Without this rule, there would be no procedures for the division in regards to preservation easements; therefore, this rule should be continued.
