    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule is authorized by the Utah Procurement Code, Title 63G, Chapter 6a. In addition to the reciprocal preference requirements contained in Section 63G-6a-1002 for the providers of procurement items produced, manufactured, mined, grown, or performed in Utah, Rule R33-10 outlines the process for award of a contract when there is more than one equally low preferred bidder.

    There have been no comments received either supporting or opposing the rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule needs to be continued because it outlines the process for award of contract when there is more than one equally low preferred bidder. This rule provides additional requirements and procedures and must be used in conjunction with the Procurement Code.
