The rule is enacted under rulemaking authority granted to the Utah Division of Aging and Adult Services by Section 62A-3-104 and by the Older Americans Act, which requires the maintenance of a nutrition program for the elderly as a condition of the state receiving federal funding.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
As stated above, the state is required to create and maintain a nutrition program for the elderly in order to be considered a state unit on aging by the federal government and to continue receiving federal funding. Therefore, this rule should be continued.
