    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Under Subsection 63-2-502(2)(a), the State Records Committee may make rules to govern its proceedings. This rule explains the procedures for a prehearing conference before the State Records Committee.

     

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received in the past five years.

     

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule allows for prehearing conferences between the State Records Committee chair, the petitioner, and a representative from the governmental entity to encourage communication between the parties and to facilitate settlement of the apppeal. Therefore, this rule should be continued.
