This rule is promulgated under Subsection 4-2-2(1)(e) which allows the department to make and adopt rules regarding market orders.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received regarding the tart cherry marketing order.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The market order is at the request of the producers. Industry can call a referendum vote once a year with 10% of the industry making the request. No such referendum has been requested by industry. Therefore, this rule should be continued.
