    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    The Department has legal authority to make rules pursuant to Section 35A-1-104 and Subsection 63-46a-3(3). Title II of the Americans with Disabilities Act (ADA) requires the Department to have a complaint procedure in place for handling disability complaints.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    The Department has not received any comments since the last five-year review.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The rule is essential to establish a procedure for filing and resolving disability complaints. The Department is required to have such a procedure under the Americans with Disabilities Act. Therefore, this rule should be continued.
