Subsection 53A-1-401(3) allows the Utah State Board of Education (Board) to adopt rules in accordance with its responsibilities and Section 53A-11-1103 directs the Board to make rules governing the dissemination of information about juvenile offenders.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule continues to be necessary because it provides procedures for local education agencies to follow in notifying school personnel of offenders in their schools and for protecting the confidentiality of the information. Therefore, this rule should be continued.
