Section 35A-1-104 authorizes the Department of Workforce Services to adopt rules. Subsections 35A-1-104(4) and 35A-7-104(3) direct the Department to establish rules to determine the form and manner for sending the information required under the statute.

The Department has not received any comments since the last five-year review of this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The statute directs the Department to establish by rule the format and manner for employers to use in sending the information required by the new hire registry. Therefore, this rule should be continued.
