In the 1987 General Session of the State Legislature, Subsection 63-46b-4(2) was passed. It prescribed that "all agency adjudicative proceedings not specifically designated as informal proceedings by the agency's rules shall be conducted formally in accordance with the requirements of this chapter." The statute required action if the agency chose not to have its adjudicative proceedings conducted formally.

No written or verbal comments have been received by the State Library Division regarding Rule R223-1.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R223-1 was adopted by the State Library Division in 1988, in direct response to the State Legislature's action the previous year in passing Section 63-46b-4. No circumstances relevant to the rule or the reasons for its original adoption have changed in the interim. Therefore, this rule should be continued.
