    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule is authorized by Section 26-1-5. It clarifies the meaning of unattended death under the provisions of Subsection 26-4-2(8) and the requirements of Section 26-4-8.

     

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

     

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule eliminates the need to report a death to the Medical Examiner as "unattended" if the patient has been seen by a nurse who is under the direct supervision of the patient's treating physician even if the physician has not see the patient within 30 days prior to death. Elimination of this rule would needlessly increase the number of cases referred to the Medical Examiner. Therefore, this rule should be continued.
