    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule explains the procedures followed in the appeal process. Sections 35A-4-508 and 35A-4-406 explain how reviews will be handled. Subsection 35A-4-502(1)(b) authorizes the Department to make rules necessary for the administration of the Employment Security Act. Section 35A-1-104 authorizes the Department of Workforce Services to adopt rules. Section 35A-1-303 gives the Department the authority to adopt rules governing adjudicative procedures.

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule is essential to explain the appeals procedure including when the Department has jurisdiction and how and when appeals may be filed. Therefore, this rule should be continued.
