    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule is enacted in compliance with the Utah Administrative Procedures Act, Section 63G-4-102 et seq. and applies only to actions governed by the Act. The Division of State History designates all agency actions subject to the scope and applicability of the Utah Administrative Procedures Act as formal proceedings.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No comments have been received during the past five years either in support of or opposition to the rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    It is important to have an effective administrative procedure for the Division of State History whereby any person aggrieved by a decision or determination may have a process by which to formally aggrieve that decision or determination. Therefore, this rule should be continued.
