    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 19-6-105 allows the board to set minimum standards for protection of human health and the environment for the storage, collection, transport, recovery, treatment, and disposal of solid waste. The Resource Conservation and Recovery Act (RCRA) section 3006 requires that authorized State programs be "equivalent" to the Federal program.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The rule is necessary for Utah to maintain its equivalency with EPA regulations for program authorization and to provide standards for the handling of universal wastes (waste batteries, mercury-containing thermostats and lamps, certain recalled, obsolete, or unused pesticides). Therefore, this rule should be continued.
