Section 62A-1-111 authorizes the Department of Human Services to make administrative rules.

There have not been any written comments received since the last five-year review of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is to be continued to implement provisions required by 45 CFR Part 164, subpart E, dealing with the treatment of certain individually identifiable health information held by the Department of Human Services. Upon review of this rule, the department notes that this rule needs to be amended to correct the citation for rulemaking authority and to correct some minor typographical errors. That amendment will be filed concurrently with this filing. (DAR NOTE: See the proposed amendment to Rule R495-881 under DAR No. 31485 in this issue, June 15, 2008, of the Bulletin.)
