This rule was enacted under the authority of Sections 41-1a-231, 72-1-201, and 72-9-201, which give the Department authority to establish standards and procedures regarding the technical details of administration of the state transportation system.

The Legislature continues to vest in the Department authority to set up these standards and procedures. The current rule adequately carries out that duty and therefore, the rule should be continued.
