NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule was enacted under Section 19-2-104. Section 19-2-104 authorizes the Air Quality Board to promulgate rules "regarding the control, abatement, and prevention of air pollution from all sources and the establishment of the maximum quantity of air pollutants that may be emitted by an air pollutant source." Rule R307-424 controls mercury emissions from coal-fired electric generating units. It also establishes maximum allowable quantities of mercury that may be emitted by a source. Each of these regulatory actions (controlling emissions and setting emission standards) are allowed under Section 19-2-104.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There were no comments in opposition to this rule since the last five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule should be continued because it sets mercury emission limits for coal-fired power plants. It also implements federal emission standards found in 40 CFR 61.24 and is required by Section 111(d) of the Clean Air Act.
