NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53A-1-402(1)(b) directs the Utah State Board of Education to establish rules and minimum standards for access to programs. Section 53A-11-102.5 directs the Utah State Board of Education to make rules to permit home school, charter, and online students and private school students to participate in traditional public school extracurricular or co-curricular school activities.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule continues to provide procedures and criteria for home school, private school, online, and charter school students' participation in traditional public school activities. Therefore, this rule should be continued.
