    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Title 19, Chapter 4, Safe Drinking Water Act, gives the Drinking Water Board the authority to promulgate rules that govern the construction of facilities and quality of water provided by public water systems.

     

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received by the Division on this rule other than those received during a formal proposed rule change. The comments received during the rule change were related to incorrect citations of 40 CFR 141 and the requirement to potentially provide public notice in a second language. The citations were corrected in subsequent rulemaking and the non-English issue was resolved.

     

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The rule outlines the public notification requirements of a public water system if it exceed a drinking water quality standard. The requirements of this rule are also specified in 40 CFR 141 by the United States Environmental Protection Agency under authority of the Federal Safe Drinking Water Act. The Drinking Water Board is required to adopt rules that are as stringent as the federal rules in order to maintain primacy for enforcement of the drinking water program. The continuation of the rule is necessary to ensure timely notification of the public water system consumers in the event a water quality standard is exceeded and to maintain primacy of the drinking water program.
