NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53A-13-101.6 directs the Utah State Board of Education (Board) to provide a rule for a program of instruction within the public schools relating to the flag of the United States, and by Subsection 53A-1-401(3) which allows the Board to adopt rules in accordance with its responsibilities.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comment has been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule continues to be necessary because it provides direction for patriotic education programs in the public schools as required by state law. Therefore, this rule should be continued.
