    The amendment adds language to comply with Section 67-20-4.

    Language is added to require Executive Director approval for volunteer service, as required under Section 67-20-4.

    Comments by the department head on the fiscal impact the rule may have on businesses:

    Rules published by the Department of Human Resource Management (DHRM) have no direct effect on businesses or any entity outside state government. DHRM has authority to write rules only to the extent allowed by the Utah Personnel Management Act, Title 67, Chapter 19. This act limits the provisions of career service and these rules to employees of the executive branch of state government. The only possible impact may be a very slight, indirect effect if an agency passes costs or savings on to business through fees. However, it is anticipated that the minimal costs associated with these changes will be absorbed by agency budgets and will have no effect on business.

    R477. Human Resource Management, Administration.

    R477-13. Volunteer Programs.

    R477-13-1. Volunteer Programs.

    (1) Agency management may establish a volunteer program.

    (a) A volunteer program shall include:

    (i) documented agreement of the type of work and duration for which the volunteer services will be provided;

    (ii) orientation to the conditions of state service and the volunteer's specific assignments;

    (iii) adequate supervision of the volunteer; and

    (iv) documented hours worked by a volunteer.

    (2) A volunteer may not donate any service to an agency unless the volunteer's services are approved by the agency head or designee, and by DHRM.

    (a) Agency management shall approve all work programs for volunteers before volunteers serve the state or any agency or subdivisions of the state.

    (3) A volunteer is considered a government employee for purposes of workers' compensation, operation of motor vehicles or equipment, if properly licensed and authorized to do so, and liability protection and indemnification.

    (4) The Executive Director, DHRM, may authorize exceptions to this rule consistent with Subsection R477-2-2(1).
