NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 34A-1-104 gives the Labor Commission authority to establish rules to administer the Workers' Compensation Act and the Occupational Disease Act. Subsection 34A-2-407(8) requires health care providers, except hospitals, to comply with the commission's rules.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received during or since the last five-year review of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

In light of the commission's continuing statutory responsibility to administer Utah's workers' compensation system, it remains necessary for the commission to address issues relating to health care providers, such as the proper codes to use in billing and the amount providers will be paid for their services. It is also necessary for the commission to establish rules to maintain consistency in the handling of injured workers claims so this rule should be continued.
