    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule is authorized by Subsection 26-33a-104(1) to "direct a statewide effort to collect, analyze, and distribute health care data to facilitate the promotion and accessibility of quality and cost-effective health care and also to facilitate interaction among those with concern for health care issues."

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comment has been received since the last review of the rule. At its quarterly meeting on 04/08/2008, the Utah Health Data Committee reviewed the rule and requested its continuation.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule establishes the process for the collection and audit of HMO and health plans' performance measures from all licensed health maintenance organizations in Utah. Annual public reports on HMO performance have been widely used to monitor the quality of care for the people of Utah by public health programs, HMOs, policy makers, and health care purchasers and consumers. The broad uses of the data and reports are justifications for continuation of the rule.
