    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule is authorized by Subsection 26-15-2(8) which requires the Department to adopt rules and enforce minimum standards of sanitation to protect public health for roadway rest stops.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    The Department of Health has not received any written comments regarding this rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The Utah Department of Health is required by statute to establish minimum sanitation standards for roadway rest stops. Additionally, the Environmental Health Directors at all 12 local health departments have indicated to the Department that there is need for this rule to remain in effect. This rule is currently being enforced by the local health departments statewide. Proper sanitation regulation of roadway rest stops remains important to protect the traveling public in Utah. Therefore, this rule should be continued.
