    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 61-2b-6(1)(l) authorizes the Division of Real Estate to adopt, with the concurrence of the Appraiser Board, rules for the administration of the appraiser licensing chapter. Subsections 61-2b-8(1)(a) and (b) require the Appraiser Board to determine the education requirements for persons licensed and certified under the chapter.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The federal Appraisal Subcommittee requires the states to license and certify appraisers in accordance with the standards established by the Appraisal Qualifications Board. It is therefore necessary for the Utah Appraiser Licensing and Certification Board to make rules specifying the education requirements for licensing and certification. Therefore, this rule should be continued.
