NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 61-2-5.5(1)(a)(vii) authorizes the Real Estate Commission to make rules for the administration of the real estate licensing chapter including property management rules.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

It is helpful to have an administrative rule that sets forth with specificity which of the acts that are performed in the management of property require a real estate license and which may be done by an unlicensed person under the supervision of a licensed property management company. Therefore, this rule should be continued.
