NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 26-18-304 states the department shall establish rules in accordance with Title 63, Chapter 46a, governing the process and criteria for awarding grants.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received. No opposition is expected. A verbal comment was received requesting the expansion of the Primary Care Grants Program to include model practices in the delivery of primary care, in order for them to have a mechanism to promote and improve statewide health care delivery.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Continuation of the rule allows the department to proceed in awarding grants to public and nonprofit entities to provide primary health care services to medically underserved populations.
