This rule is authorized by Section 26-1-5. This rule clarifies the meaning of unintended under the provisions of Subsection 26-4-28(8), and the requirements of Section 26-4-8.

No written comments were received during and since the last five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule clarifies the definition if what is an "unattended death". This rule's provisions help assure that deaths which can be appropriately certified by a treating health practitioner do not unnecessarily come to the Office of the Medical Examiner for investigation, examination, and certification. Therefore, this rule should be continued.
