This rule is authorized by Section 26-1-5. It clarifies the meaning of "unattended" under the provisions of Subsection 26-4-2(8) and the requirements of Section 26-4-8.

The rule clarifies the definition if what is an "unattended death". Its provisions help assure that deaths which can be appropriately certified by a treating health practitioner do not unnecessarily come to the Office of the Medical Examiner for investigation, examination, and certification. Therefore, this rule should be continued.
