    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 53A-14-102 directs the Utah State Board of Education (Board) to appoint an Instructional Materials Commission (Commission) and directs the Commission to evaluate instructional materials for recommendation by the Board, Section 53A-14-107 directs the Board to make rules that establish the qualifications of the independent parties who may evaluate and map the alignment of the primary instructional materials and requirements for the detailed summary of the evaluation and its placement on a public website, and Subsection 53A-1-401(3) allows the Board to make rules in accordance with its responsibilities.

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because it provides operating procedures and criteria for recommending instructional materials for use in Utah public schools and mapping and alignment of primary instructional materials consistent with state law. Therefore, this rule should be continued.
