NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53A-1-401(3) authorizes the Utah State Board of Education to adopt rules in accordance with its responsibilities. Section 53A-17a-131.15 directs the Utah State Board of Education to have a rule for distribution of funds for the electronic high school.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Utah state law continues to require that the Utah State Board of Education have a rule in place for distribution of funds for the electronic high school program. This rule provides the required information. Therefore, this rule should be continued.
