    Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law, and Section 26-18-3 requires the Department to administer the Medicaid program.

    No written or oral comments have been received regarding this rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule is necessary because it implements the provision of physical and occupational therapy for Medicaid clients. The rule also contains criteria to ensure medically necessary and cost effective services under the care of qualified and licensed providers. Therefore, this rule should be continued.
