    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule is required by Subsection 26-33a-104(2)(a): "The committee shall: (a) develop and adopt by rule, following public hearing and comments, a health data plan that shall among its elements."

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    The Office of Health Care Statistics has not received any written comments during and since the last five-year review of the rule from interested persons supporting or opposing the rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Rule R428-1 establishes the basic operational requirement for the Health Data Committee (HDC) to manage the data collection, analysis, and distribution, that is, to adopt a health data plan through a public process. Since the last five-year review of Rule R428-1, the HDC developed and adopted the Utah Pharmacy Data Plan, Version 1 on 04/22/2004 (to view the plan go to http://health.utah.gov/hda/UtahPharmacyDataPlan.pdf). Since 2002, the HDC also updated its Health Data Plan biennially. The Health Data Plan Update documents were included in the HDC biennial report submitted to the Governor and legislators who served on the Health and Human Services Committees. The Health Data Plan Update serves as a strategic planning document for the HDC to identify and monitor priority projects or initiatives.
