    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 53A-24-103 places the Utah State Office of Rehabilitation under the policy direction of the Utah State Board of Education. Subsection 53A-1-401(3) authorizes the Utah State Board of Education to adopt rules and policies in accordance with its responsibilities.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comment has been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because it provides procedures for designated Utah State Office of Rehabilitation employees who have significant unsupervised access to clients to have criminal background checks in order to provide protection for clients. Therefore, this rule should be continued.
