This rule is authorized under Section 26-1-5 which grants the Utah Department of Health the power to adopt, amend, or rescind rules which shall have the force and effect of law. In addition, Section 26-18-3 requires the Department to implement the Medicaid program through administrative rules. Furthermore, 42 CFR 440.110 authorizes diagnostic, screening, preventive, or corrective services provided by or under the direction of a speech pathologist.

No written or oral comments have been received regarding this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule should be continued in order to provide speech-language pathology services to eligible Medicaid clients for whom the services are medically necessary.
