Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 41-6a-518(8)(a) requires the commissioner of the Department Public Safety to make rules setting standards for the certification of ignition interlock systems. Subsection 41-6a-518(8)(c) allows the commissioner to adopt in whole or in part, the guidelines, rules, studies, or independent laboratory tests relied upon in certification of ignition interlock systems by other states.

No written comments have been received since the last five-year review of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is required under Subsection 41-6a-518(8)(a) in order to set standards for the certification of ignition interlock systems. Therefore, this rule should be continued.
