Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53A-11-1305 directs the Utah State Board of Education (Board) and local education agencies (LEAs) to adopt rules to protect students against unreasonable and excessive intrusion of personal rights; and Section 53A-1-401 allows the Board to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comment has been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R277-615 continues to be necessary because it provides standards and procedures for LEAs to use when adopting policies on student searches. Therefore, the rule should be continued.
