Pursuant to Section 53-7-204, the legislature adopted the 2015 International Fire Code (IFC) as the Utah State Fire Code. Under this adoption, the Utah Fire Prevention Board adopts minimum standards for the prevention of fire and for the protection of life and property against fire and panic in any day care facility or children's home.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments were received during the past five years.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Not only does the State Fire Code allow for the protection of day care facilities, it also is in harmony with the Day Care Rules of the Utah State Health Department which also has rules pertaining to the protection of life and related issues at daycare facilities (see Health rules under Title R381). It is critical that these two sets of rules are compatible as specific amendments are adopted in statute for the fire code to be compatible with the health code. Therefore, this rule should be continued.
